1. Seller

2. Introductory provisions

These terms govern the rights and obligations of the seller and the buyer when purchasing goods and services through the e-digiroot.net online shop. The buyer is either a consumer (a natural person not acting within their business activity) or a business. Provisions on consumers do not apply to businesses; relations with businesses are governed by the Slovak Commercial Code.

In addition to these terms, the special Terms of the Remote IT Service (for individuals and for businesses) apply to the remote IT service. In case of conflict, the special terms prevail.

The contract can be concluded in the Slovak language. Translations on the website are for information only; the Slovak version is binding.

3. Order and conclusion of the contract

  • The presentation of goods on the website is not an offer to conclude a contract. An order sent with the button labelled “Order with obligation to pay” (or similar) is the buyer’s offer.
  • The contract is concluded when the order confirmation is delivered to the buyer by e-mail. The confirmation contains these terms or a link to them.
  • Before sending the order, the buyer can check and correct the entered data in the cart and at checkout.
  • The seller may refuse an order, in particular if the goods are no longer available or the price was obviously stated in error. In that case, any amount paid will be refunded within 14 days.

4. Prices

Prices are stated in euros including VAT. For remote IT service packages for businesses, the price excluding VAT is also shown. Delivery costs are shown in the cart before the order is sent. For discounts, the lowest price at which the goods were offered during the 30 days before the discount is also stated.

5. Payment terms

  • The buyer chooses from the options offered at checkout: payment by card or another electronic method (e.g. Apple Pay, Google Pay, bank payment buttons) via the GoPay payment gateway, bank transfer to the seller’s account, or cash on delivery (physical goods only). For bank transfer, the buyer receives the account number (IBAN) and the payment reference in the order confirmation.
  • For bank transfer, payment is due within 7 days of the order confirmation. If the amount is not paid, the seller may withdraw from the contract.
  • The buyer receives the invoice (tax document) by e-mail.

6. Delivery of goods

  • Delivery methods and prices are shown at checkout. Delivery times are listed in the Delivery times section and with the product. Unless agreed otherwise, the goods will be delivered within 30 days of the conclusion of the contract at the latest.
  • The buyer is obliged to accept the goods. On receipt, we recommend checking that the parcel is intact and reporting any damage to the carrier immediately.
  • The risk of damage to the goods passes to the consumer upon receipt.
  • Remote IT service credit is added to the customer account after payment.

7. Withdrawal from the contract (consumer)

  • A consumer may withdraw from a distance contract without giving any reason within 14 days of receiving the goods (for services, from the conclusion of the contract).
  • The consumer notifies the withdrawal by an unequivocal statement, e.g. by e-mail to shop@e-digiroot.net or by post to the registered office. The model withdrawal form may be used.
  • The consumer returns the goods no later than 14 days after withdrawal to the seller’s registered office: e – digiroot, s. r. o., Winterova 1733/17, 921 01 Piešťany, Slovak Republic; the direct cost of returning the goods is borne by the consumer.
  • The seller refunds all payments, including the cost of the cheapest delivery method offered, within 14 days of withdrawal, using the same means of payment. The seller may withhold the refund until the goods have been received back or the consumer has supplied proof of having sent them.
  • The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
  • For a service whose performance began at the consumer’s express request before the end of the withdrawal period, the consumer pays for the service actually provided; once the service has been fully performed (e.g. the remote IT credit is used up), the right of withdrawal expires.
  • Withdrawal is not possible in particular for goods made to the consumer’s specifications (e.g. custom 3D-printed parts) and for sealed goods which are not suitable for return for health or hygiene reasons once unsealed.

8. Liability for defects and complaints

Rights arising from defective goods and the complaint procedure are governed by the Complaints Procedure. Liability for defects lasts 24 months from receipt of the goods (for used goods a shorter period of at least 12 months may be agreed).

9. Personal data protection

We process personal data in accordance with the Privacy Policy.

10. Dispute resolution

A consumer may ask the seller for redress (by e-mail to shop@e-digiroot.net) if they are not satisfied with how a complaint was handled or believe that the seller has violated their rights. If the seller rejects the request or does not reply within 30 days, the consumer may file a proposal to initiate alternative dispute resolution with an ADR body (e.g. the Slovak Trade Inspection, www.soi.sk; the list of ADR bodies is kept by the Ministry of Economy of the Slovak Republic). This does not affect the right to go to court.

11. Final provisions

Matters not covered by these terms are governed by the law of the Slovak Republic, in particular the Slovak Civil Code and Act No. 108/2024 Coll. on consumer protection. The choice of law does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence. The contract is archived by the seller in electronic form and the buyer receives it by e-mail. The seller may amend these terms; the version in force at the time the order was sent applies to the contract.
